Upstate Totes Privacy Policy

Effective Date: October 13, 2026

This Privacy Policy explains how Upstate Totes LLC collects, uses, and shares information when you use UpstateTotes.com, request a quote, or book a rental. In this policy, "we" and "us" (and "Upstate Totes") mean Upstate Totes LLC and its owner(s) (members and managers), and anyone who later takes over the business.

The short version: We collect what we need to deliver and pick up your totes and to talk with you about your rental. We don't sell your information. We share it only with service providers we need to run rentals, or when legally required.

1. Information We Collect

Information you give us through our quote form, booking page, email, or phone:

  • name, email address, and phone number;
  • drop-off and pickup addresses;
  • rental dates and package/add-on choices;
  • notes you choose to include, which may contain gate codes, access instructions, or other delivery details; and
  • payment information when you book (entered on our booking provider's checkout and processed by its payment processor — we don't store your full card number).

Information collected automatically: We don't currently use analytics or advertising tracking on our Site. However, like most websites, the services that deliver our Site — Cloudflare, Google Fonts, and Booqable — may automatically receive technical information such as your IP address, browser type, device information, and the pages requested, and may use cookies or similar technologies needed for security, performance, and booking functions.

2. How We Use Your Information

We use your information to:

  • respond to quote requests and questions;
  • book, schedule, deliver, and pick up your rental;
  • process payments, deposits, refunds, and any charges under our Rental Agreement;
  • communicate with you about your rental (confirmations, schedule changes, reminders, itemized notices);
  • keep the Site and our services secure and working; and
  • comply with legal, tax, and accounting obligations and enforce our agreements.

We don't use your information for advertising tracking, and we don't sell it.

2A. Text Messages and Calls

If you give us a mobile number, we use it to send texts and make calls about your rental — for example, booking confirmations, "on our way" updates for delivery and pickup, reminders, and itemized notices. We don't send marketing texts, and we don't sell or share your phone number for anyone else's marketing. Message and data rates may apply. Reply STOP at any time to stop texts (we'll then reach you by email or phone call about an open rental), or HELP for help.

2B. Photos of Equipment

We may photograph or record the Equipment at drop-off and pickup to document its count and condition. We try to frame these photos on the totes and dollies only, but they may incidentally show part of your home's exterior, entryway, or surroundings. We use them only to manage your rental, resolve questions about damage, cleaning, or missing items, and respond to payment disputes, and we keep them with your rental records (see Section 5).

2C. Cookies

Our Site doesn't use advertising or analytics cookies. The services that run the Site and booking pages (such as Cloudflare and Booqable) may set cookies or similar technologies that are necessary for security, keeping your cart or booking session working, and checkout. You can block or delete cookies in your browser settings, but some booking features may not work without them.

3. Gate Codes and Access Notes

Gate codes, door codes, and access notes are used only to complete your delivery and pickup. We delete them from our records within 7 days after your rental ends (that is, after final pickup), unless you ask us to keep them for a future rental. Please don't send codes you can't change, and consider changing temporary codes after your move.

4. Who We Share Information With

We don't sell your information. We share it only with service providers needed to run rentals, or when legally required. Our current service providers are:

  • Formspree — processes and delivers submissions from our quote form.
  • Booqable — runs our online booking and checkout (upstate-totes.booqableshop.com).
  • Payment processor (through Booqable) — processes card payments, deposits, and refunds.
  • Google Workspace — our business email, used to communicate with you and store rental correspondence.
  • Cloudflare — delivers and helps secure our website.
  • Google Fonts — provides the fonts displayed on our Site; your browser connects to Google's servers to load them.

These providers process information under their own privacy policies and terms. We may also disclose information if required by law, subpoena, or court order; to protect our rights, property, or safety or that of others (including recovering unreturned equipment or unpaid charges); or to a successor if the business is transferred or reorganized, in which case this policy would continue to apply.

5. How Long We Keep Information

  • Quote requests that don't become rentals: deleted within 12 months.
  • Rental and booking records (name, contact info, addresses, dates, charges): kept for 3 years after the rental for accounting, tax, and dispute purposes.
  • Delivery and pickup condition photos: kept with your rental records, generally deleted within 12 months after the rental unless needed for an open dispute or unpaid balance.
  • Gate codes and access notes: deleted within 7 days after final pickup (see Section 3).
  • Payment information: held by Booqable and its payment processor under their retention policies.

6. Security

We use reasonable measures to protect your information, including relying on established service providers and limiting access to the people who need it to run rentals. No method of transmission or storage is completely secure, so we can't guarantee absolute security.

7. Children

Our Site and services are not directed to children under 13, and we don't knowingly collect personal information from children under 13. If you believe a child has sent us information, contact us and we'll delete it. Rentals must be booked by adults 18 or older.

8. Your Choices and Rights

You can email us at quotes@upstatetotes.com to:

  • ask what personal information we have about you;
  • correct it; or
  • ask us to delete it.

We'll respond within a reasonable time. We may need to verify your identity, and we may keep some information where required by law or needed for an open rental, unpaid charges, or a dispute.

9. Changes to This Policy

We may update this Privacy Policy. Changes take effect when posted on this page with a new effective date. If we make significant changes — such as adding analytics or tracking — we'll update this policy before doing so.
