Upstate Totes Website Terms of Service

Effective Date: October 18, 2026

These Terms of Service ("Terms") cover your use of UpstateTotes.com and our online booking and quote pages (the "Site"). The Site is run by Upstate Totes LLC, 201-B West Butler Rd, Suite 120, Mauldin, SC 29662. In these Terms, "we" and "us" (and "Upstate Totes") mean Upstate Totes LLC and its owner(s) (members and managers). When these Terms limit our liability or give us a release, those protections also apply to our employees, agents, and contractors, and to anyone who later takes over the business. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. Rentals Are Governed by the Rental Agreement

Every tote and dolly rental is governed by our Rental Agreement (available at /rental-agreement), which you accept when you book. If these Terms and the Rental Agreement conflict on anything about a rental, the Rental Agreement controls.

2. Using the Site

You may use the Site to learn about our services, request quotes, and book rentals. Please don't:

  • submit false information or book on someone else's behalf without permission;
  • interfere with the Site's operation, security, or the services that power it;
  • scrape, copy, or reuse Site content for commercial purposes without our permission; or
  • use the Site for anything unlawful.

3. Quotes and Bookings

Quote requests submitted through our quote form are requests only. A quote is not binding, and no rental is reserved, until we confirm it by email. Bookings made through our online booking page (hosted by Booqable at upstate-totes.booqableshop.com) are subject to availability and the Rental Agreement.

3A. Our Right to Decline or Cancel

We may decline or cancel any quote or booking — and refund any amount you've paid for it, including your deposit — if we suspect fraud or unauthorized payment, if the information provided appears false or incomplete, if the address is outside our service area, if there is a pricing or availability error, or if we're otherwise unable to provide the service.

4. Pricing

Prices on the Site are our current prices and may change at any time. The price shown in your booking confirmation applies to that booking. We try to keep the Site accurate, but if we find an error in pricing or availability, we'll let you know and you can choose to continue at the correct price or cancel.

All prices are plus applicable South Carolina sales tax.

Price match. We'll match any local competitor's current published price for the same number of totes and rental length, in our service area. Show us their price page before you book. Excludes coupons, promotions and limited-time deals. One match per order. We decide whether an offer is comparable, and matches don't apply to orders that are already paid.

5. Estimates (Savings Calculator and CO2 Figures)

Any savings calculator results, cost comparisons, CO2 or environmental-impact figures, and similar numbers on the Site are estimates for general information only. They are based on assumptions and your actual results will vary. They are not promises or guarantees.

6. Service Area and Availability

We offer free delivery and pickup in the Upstate South Carolina counties we serve, generally between 7 AM and 7 PM. All services are subject to service area and availability. We may not be able to serve every address, date, or time, and we may decline or reschedule a booking if needed.

7. Cleaning

We clean and inspect totes between rentals. Because totes are reusable and handled by many customers, we can't guarantee that every tote will be free of every mark, scuff, or trace of prior use. If something isn't right when you receive your totes, please let us know.

8. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, about the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Site will always be available, error-free, or secure. Third-party services we use (such as booking and form providers) are operated by those companies under their own terms.

9. Limitation of Liability

To the fullest extent permitted by South Carolina law, Upstate Totes (including its owner(s)) will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site. Our total liability for any claim related to the Site is limited to $100 or the amount you paid us in the 12 months before the claim, whichever is greater. Nothing here limits liability that cannot be limited by law. Liability for rentals is addressed in the Rental Agreement.

10. Intellectual Property

The Site's content — including the Upstate Totes name, logo, text, graphics, and photos — belongs to us or our licensors and is protected by law. You may view and share Site pages for personal, non-commercial use. Any other use requires our written permission.

10A. Reviews, Photos, and Other Content You Send Us

If you send us or post about us reviews, testimonials, photos, videos, or comments, you confirm you have the right to share them and that they don't violate anyone else's rights. You give us a non-exclusive, royalty-free, perpetual permission to use, copy, display, and share that content (and the first name or display name you attach to it) in connection with promoting and operating Upstate Totes. We may edit it for length or clarity without changing its meaning. We won't publish your full address or other private details from a photo, and you can ask us to stop using your content at any time going forward. We may remove or decline to use any content for any reason.

10B. Third-Party Sites and Services

The Site may link to or rely on third-party sites and services (such as Booqable, payment processors, and social media). We don't control them and aren't responsible for their content, availability, or practices; your use of them is subject to their own terms and policies.

11. Privacy

Our Privacy Policy (available at /privacy) explains what information we collect and how we use it.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the Site with a new effective date. Continuing to use the Site after changes are posted means you accept them.

13. Governing Law and Venue

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Any lawsuit related to the Site or these Terms will be brought in the state courts located in Greenville County, South Carolina.

14. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. These Terms, the Rental Agreement, and the Privacy Policy are the entire agreement between you and us about the Site.
